User Eligibility

There are no strict age restrictions to use RogueDB. However, if you are under the age of 18, you are advised to obtain parental or guardian permission before creating an account or using our services. Given the nature of a database infrastructure service, there is no risk of encountering explicit or inappropriate material provided by RogueDB.

Trademarks

Logos, trademarks, and service marks displayed on this website are the property of MongoDB and third-parties. Written consent from the respective owners is required to use these materials. Any use of the materials is strictly prohibited otherwise.

Copyrights

The intellectual property rights in the HTML, text, images, audio, video, software, or other content made available on this website is either owned by RogueDB or permission obtained from the owner of the intellectual property for use. Redistribution or copying of any part of the website or its content is strictly prohibited without written permission from RogueDB.

RogueDB authorizes the intellectual property to be displayed, downloaded, and printed from this website provided the following:

• Copyright notice appears on displayed material.
• Information is not altered.
• Content is used for personal, education, and non-commercial use only.
• No redistribution or copying of information to any other media.

The application programming interface ("API") defined on the website and available through our services are copyrighted by RogueDB with no permission granted to utilize outside of the services provided.

Intellectual Property Rights and Ownership

This agreement does not transfer any right, title, or interest in any intellectual property to any party. Confidential or proprietary information provided by RogueDB may only be used for the evaluation of services and entitled to a high degree of care to avoid disclosure by you without prior written consent. Obligations to maintain confidentiality extends for three years after the termination of this agreement.

Promotionals with Technical Support

Technical Support when included in a promotional constitutes up to 8 hours a month for database migration, initial setup, performance issues, and general usage questions. This does not include direct contributions, modification, addition, or removal of customer source code. Any code provided or suggested during technical support is free of liability with no guarantees of being error free, working, compiling, running, or otherwise operating as intended. The customer is responsible for any and all code used in their systems provided by RogueDB.

Software Use

Any software that is made available from this website is the copyrighted work of RogueDB and/or third parties. Your use of the software is governed by the Terms of Use which accompanies or is included with the software. Unless you first agree to the Terms of Use, you will not use or install any software from RogueDB.

Software is warranted, if at all, in accordance with the Terms of Use. All expressed or implied conditions, representations, and warranties, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement are disclaimed except to the extent that the law requires to be legally invalid.

Data

You are responsible for the activities and data associated with the services offered by RogueDB. This includes representatives, employees, unauthorized persons, or third-parties. The security, protection, and back-up of your data is your responsibility. RogueDB has no obligation to maintain or store data associated with our services after termination of this agreement or services.

Feedback and Ideas

RogueDB does not accept any unsolicited feedback or ideas for advertising, promotions, products, technologies, processes, material, marketing plans, product names, branding, or any other material. Any submission by an individual waives the right for the information to be confidential or proprietary and any intellectual or copyright rights associated with the feedback and ideas.

Rules of Conduct

Any modification to the website's design, functionality, availability, depiction, or any deviation from the original deployment are not permitted by RogueDB and constitutes a violation of criminal and civil laws. You are not permitted to recreate, replicate, modify, fork, or any way derive the source code and the intellectual property of services offered by RogueDB. In addition, you are not permitted to resell or sub-license the services provided. You are not permitted to subvert the security measures and mechanisms utilized to protect the website and services.

Term and Termination

You may terminate this agreement at any time by deleting your account and terminating your associated services. RogueDB may terminate this agreement for any reason provided a 30 days' advance notice.

Immediate termination or discontinuing of services by RogueDB will occur due to one or more of the following conditions being met by you:

• Alteration to the provision of services or discontinuing of services.
• Late payment.
• Breach of agreement.
• Reasonable determination of a risk associated with the continuance of services due to your use.
• Use of services is unlawful.
• Ceased to operate in the ordinary course, made an assignment for the benefit of creditors or similar disposition of your assets, or become the subject of any bankruptcy, reorganization, liquidation, dissolution or similar proceeding.

All fees and charges incurred up to the date of termination remain your responsibility.

Payments, Cancellation, and Modification

All payments are non-refundable. Cancellations do not result in a refund. The following policies apply to services that are modified during an active billing cycle:

• Downgrades: Downgrades of any kind for the database engine, storage, or transitioning to a shorter commitment period take effect at the end of the current billing cycle.
• Upgrades: Upgrades of any kind for the database engine, storage, or transitioning to a longer commitment period take effect immediately. Your account will be credited for the unused portion of the remaining billing cycle.

Indemnification

Any person or corporation submitting content to this website agrees to defend, indemnify and hold RogueDB and its owners, employees, agents, and licensors harmless from and against any and all claims, losses, liabilities and expenses (including attorneys' fees) related to or arising out of such submitted content, including without limitation claims made by third-parties related to any false advertising claims, liability claims for products or services sold by the person or corporation submitting such content, claims for patent, copyright or trademark infringement, claims due to disruption or malfunction of services provided (pertaining to the submitted content), even if such content is reviewed by RogueDB prior to publishing on the website.

Export Control

Use of the website and services must comply with all applicable US and foreign government import and export controls. Access to this website and services outside the US and compliance with the laws of your jurisdiction are done at your own risk with sole responsibility of all usage and compliance. By using this website or services, you represent and warrant not being a national or resident of a country with US embargoed goods, under the influence or control of an embargoed country, or located in an embargoed country.

Law Enforcement Requests

RogueDB may disclose your information pursuant to law enforcement's request for information. We will evaluate requests to ascertain proper issuing. If legally permitted, RogueDB will notify you that a request has been made.

• SERVICES, HARDWARE, OR SOFTWARE ROGUEDB USES TO PROVIDE SERVICES SUCH AS CLOUD PLATFORM SERVICES.
• USE OF EQUIPMENT OR AUTHENTICATION TO ACCESS OUR NETWORK AND SERVICES.
• IMPROPER USE, SCALING, OR CONFIGURATION BY YOU OR A THIRD-PARTY.
• YOUR FAILURE TO FOLLOW APPROPRIATE SECURITY PRACTICES.

ROGUEDB'S TOTAL AGGREGATE LIABILITY, REGARDLESS OF THE FORM OF THE CAUSE OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING WITHOUT LIMITATION NEGLIGENCE), STATUTE OR OTHERWISE, AND YOUR SOLE AND EXCLUSIVE REMEDY, SHALL BE LIMITED TO PROVEN DIRECT DAMAGES CAUSED BY ROGUEDB IN AN AMOUNT NOT TO EXCEED FIVE HUNDRED DOLLARS (USD $500.00) OR THE AMOUNT PAID FOR USAGE OF SERVICES FROM USE PRECEDING 1 MONTH OF THE CLAIM. THE PROVISIONS OF THIS SECTION ALLOCATE RISKS UNDER THESE TERMS OF USE BETWEEN ROGUEDB AND YOU. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS IN ITS ESSENTIAL PURPOSE. TO THE EXTENT ANY JURISDICTION DOES NOT ALLOW THE EXCLUSION OR LIMITATION OF DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, PORTIONS OF THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY.

Governing Law and Jurisdiction

These Terms of Use and your use of the website and services are governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. Any legal action or proceeding arising under this agreement will be brought exclusively in the federal or state courts located in Alabama, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

Severability

If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms of Use, along with the Privacy Notice, constitute the entire agreement between you and RogueDB regarding the use of the website and services, superseding any prior agreements, understandings, or communications between you and RogueDB.
